MEMORANDUM OF ASSOCIATION
OF MEN-TSEE-KHANG
(Tibetan Medical & Astrological Institute of His Holiness
the Dalai Lama)
(Registered Under The Societies Registration
Act, 1860)
- The name of the Society shall be Men-Tsee-Khang
(Tibetan Medical and Astrological Institute)
- The registered office of the Men-Tsee-Khang
(Tibetan Medical and Astrological Institute) shall be
at Dharamsala, Distt. Kangra, Himachal Pradesh or at
any other place as the Governing Body may determined.
- The aims and objective for which the
Men-Tsee-Khang (Tibetan Medical and Astrological Institute)
is established are:
- To preserve and promote the ancient
Tibetan medical and astrological traditions.
- To take over the whole or such part
as can be legally vested in the Society of the property
of the unregistered organisation called "Men-Tsee-Khang"
having its ofice at Mcleod Gunj, Dharamsala Cantt.,
Distt. Kangra, H.P.
- To maintain and improve sanitation
and health of the locality wherein the refugee are
settled and to establish dispensaries, hospitals,
and health propaganda centres for the improvement
of the health and sanitation of the refugees in
particular and the public in general
- To provide for research and higher
studies in the fields of Tibetan medicine and astrology
and to award stipends, degrees and scholarships
for that purpose
- To start, build or construct medical
schools training centres for medical education,
laboraties and furnish them with necessary furniture
and equipment
- To start and maintain libraries or
reading rooms for students and the public
- To open and maintain museums and
galleries of paintings and other works connected
with the ancient Tibetan Medical and astrological
traditions
- To cooperate with scholars and institutes
in India and abroad in the higher study and research
on Tibetan medicine and astrology
- To organise or participate in courses
of study, research,and seminars both in India and
abroad
- To accept subscriptions and donations
and devices and requests from individuals and associations
and to raise funds by charity shows, fCTAball matches
etc., and other lawful means including marketing
the products of the institute for all or any of
the purposes aforesaid and to hold and manage the
fund or funds accepted or raised by the society
and generally to manage, invest and expend all moneys
and properties belonging to the society
- To sell, improve, manage and develop
all or in any part of the property or properties
of the society
- To borrow, raise or secure the payment
of money by mortgage, charge or by hypothecation
of the property of the society or otherwise in such
manner as the society may consider fit and proper
for achieving the objects of the Society
- To execute all deed, agreements and
other documents and to sign all receipts in connection
with the affairs of the society
- To deposit all money belonging to
the Men-Tsee-Khang in such bank or banks or invest
them in approve securities as the Governing Body
may decide
- To maintain proper accounts, registeres
and other records and prepare an annual statements
of accounts including the balance sheet in the form
prescribed by law
- To forward annually a report on the
activities of Men-Tsee-Khang to the Government along
with the audited accounts
- To provide further management of
the affairs of the society in such manner as the
society shall think fit and in particular to appoint
salaried or non-salaried officers as the society
shall think fit on such terms as the society may
deem fit and proper and to discharge, dismiss, suspend,
punish or reward any such officer
- To create, consititute such committee,
sub-committee etc., as the Governing Body may deem
fit
- To delegate all or any of its powers
to be principal officers or any of its other officers
of Men-Tsee-Khang to any committee, sub-committee
etc. to any or more members of such bodies or any
one or more members of the Governing Body
- To make rules and regulations for
the conduct of the affairs of Men-Tsee-Khang and
to add, amend, vary, or rescind them from time to
time
- No immovable property of the Men-Tsee-Khang
shall be disposed in any manner whatsoever, except by
the decision of the Governing Body
- The Central or State Government may appoint
on or more persons to review the work of Men-Tsee-Khang
or any institution working under it and to hold enquiries
into the affairs thereof and to report thereon in such
manner as the Central or State Government may stipulate.
On receipt of any such report, the Central or State
Government may take such necessary action and issue
suggestions as it may consider necessary
- TheGoverning Body of Men-Tsee-Khang shall
also be the Governing Body under the Rules of the Men-Tsee-Khang
(Tibetan Medical and Astrological Institute) Rules.
The following shall be the members of the Governing
Body
His Holiness, the Dalai Lama
has very kindly agreed to be the patron of the Men-Tsee-Khang.
The income, funds, donations,
subscriptions, fees and properties, both movable and immovable
of Men-Tsee-Khang shall be applied solely towards the promotion
of the objects herein before mentioned, provided that nothing
here-in shall prevent the payment in good faith of renumeration
of any member, servant, official, any pension or body in
return for any services actually rendered to Men-Tsee-Khang.
If upon winding up or dissolutions of
Men-Tsee-Khang, there remain after satisfaction of all
its debts and liabilities, some property whatsoever,
the Governing Body shall in consultations with the Government
transfer the assets in hand, to some other institution
with similar objects as far as may be practicable in
the best of interests.
